I. GENERAL PROVISIONS

  1. These Regulations define the rules for using the services of Wesoła Immersive – New Media Art Center (hereinafter: "Wesoła Immersive"), located at Kopernika 17A in Kraków.


  2. Every person present on the premises of Wesoła Immersive, and in particular every person participating in Exhibitions or Events organized at Wesoła Immersive, is obliged to comply with the provisions of this document.

  3. The operator of Wesoła Immersive is IMMERSIO ARTE Sp. z o.o. with its registered office at ul. Stoczniowców 5, 30-709 Kraków, NIP (Tax Identification Number): 6793319477, e-mail: office@immersioarte.com.

  4. The purchase of a ticket and entry to the Wesoła Immersive premises is equivalent to accepting these Regulations.

  5. The Regulations are available on the Wesoła Immersive website and in the Café-Club located on the premises.

  6. Wesoła Immersive is open from Tuesday to Sunday from 10:00 AM to 10:00 PM. The last entry is no later than 30 minutes before closing time.

  7. The Operator reserves the right to change the opening hours and to temporarily close the exhibition spaces.

  8. Wesoła Immersive may limit the number of people simultaneously present in the exhibition spaces.

II. VISITOR RULES

  1. Entry to the exhibition area of Wesoła Immersive is possible only upon presentation of a valid ticket (indicating, among other things, the correct date, time, and name).

  2. Visitors must follow the instructions of the staff.

  3. In the exhibition areas, the following are forbidden:

    • Touching exhibition elements (unless indicated otherwise), or destroying exhibition elements and equipment,

    • Bringing in food and drinks,

    • Bringing in and consuming intoxicating or psychotropic substances,

    • Bringing in large items, in particular luggage, bicycles, scooters, or skateboards,

    • Smoking tobacco and e-cigarettes,

    • Loud behavior, running, and disturbing the peace,

    • Bringing in dangerous items and substances, in particular weapons, sharp tools, explosives and pyrotechnics, flammable materials, corrosive substances, and chemicals,

    • Recording with a tripod or flash photography,

    • Conducting commercial activities without the Operator's consent.

  4. A monitoring system is in operation at Wesoła Immersive.

  5. Individuals who violate the regulations, endanger the safety of others, or disturb the comfort of other visitors may be asked to leave the premises without a refund.

  6. The exhibitions may use light and sound effects that can affect the well-being of some visitors. Therefore, they are not recommended for individuals with epilepsy, anxiety disorders, heart conditions, seizure disorders, or sensitivity to flashing lights, as well as for those who may easily lose their balance.

III. RULES FOR MINORS

  1. Children and youths under the age of 13 may be present on the premises of Wesoła Immersive only under the supervision of an adult (a legal guardian or a person authorized by the guardian).

  2. Minors between the ages of 13 and 17 may be present on the premises of Wesoła Immersive unaccompanied, provided they have the consent of a legal guardian to participate in the visit or event.

  3. Wesoła Immersive is not liable for minors present on its premises without adult supervision if their presence violates these regulations.

  4. Wesoła Immersive employees have the right to refuse entry or ask a minor to leave the museum premises if:

    • they are on the premises in violation of the rules specified in sections 1-2,

    • their behavior endangers safety or public order,

    • it is not possible to ensure proper supervision for them.

IV. TICKET SALES

  1. Tickets are available online through the website: www.wesola.im and on-site at the Café-Club located in the Wesoła Immersive building.

  2. The Organizer makes tickets available for sale for a minimum of 14 days and a maximum of 100 days in advance.

  3. The current ticket price list is available on the website: www.wesola.im. Prices include VAT and are expressed in PLN.

  4. Data required for online purchases: first name, last name, e-mail, and consent for data processing. A ticket purchased online is sent automatically by the system once payment is made via the online payment operator.

  5. A ticket is valid for a single entry, and leaving the exhibition area terminates its validity.

  6. Discounts are granted upon presentation of valid documents. Wesoła Immersive staff have the right to request the presentation of a document entitling the holder to a specific type of discount, as indicated on the purchased ticket.

  7. At the Customer's request, submitted in accordance with the law, in particular the Act of March 11, 2004, on the tax on goods and services (Journal of Laws of 2004, No. 54, item 535, as amended), it is possible to issue a VAT invoice or a pro forma invoice.

  8. In the event of the closure of Wesoła Immersive for reasons beyond its control, refunds will be processed in accordance with the law.

V. USE OF THE WEBSITE

  1. The website is used for purchasing tickets, subscribing to the newsletter, and providing information about our offers.

  2. Unauthorized copying of content and disruption of the website's operation are prohibited.

  3. The Operator reserves the right to temporarily shut down the website for maintenance purposes.

VI. PERSONAL DATA AND IMAGE

  1. The data controller is IMMERSIO ARTE Sp. z o.o.

  2. Data is processed for the purposes of customer service, sales, marketing, and security.

  3. Data is processed in accordance with the GDPR (RODO).

  4. Images may be recorded for documentation and promotional purposes.

  5. Everyone has the right to access, correct, and delete their data.

VII. COMPLAINTS AND TICKET RETURNS

  1. Pursuant to Art. 38(1)(12) of the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827, as amended), the right to withdraw from a contract concluded off-premises or at a distance is not granted to the Consumer in relation to contracts for the provision of services related to entertainment, sporting, or cultural events, if the contract specifies the day or period of service provision.

  2. In view of the above, returning tickets purchased online is not possible, except in exceptional cases (e.g., unexpected closure of the exhibition or a significant change in the exhibition's character).

  3. A request to return a ticket purchased online should be submitted by e-mail to: office@immersioarte.com (the processing time is a maximum of 14 working days).

  4. If the return is approved, the refund will be credited to the buyer's account within 10 working days.

  5. Unused tickets purchased on-site at the Café-Club can be returned at the place of purchase.

  6. Any complaints regarding exhibitions or tickets should be sent to: office@immersioarte.com.

  7. The time for processing a complaint is 14 working days; however, this period may be extended in exceptional circumstances.

VIII. FINAL PROVISIONS

  1. The Operator reserves the right to amend the Regulations.

  2. In matters not covered by these Regulations, the provisions of civil law shall apply.

  3. These Regulations are effective from the date of their publication on the Wesoła Immersive website, located at the address www.wesola.im/regulamin.

ANNEX: STANDARDS FOR THE PROTECTION OF MINORS AT WESOŁA IMMERSIVE

I. RULES ON THE PRESENCE OF MINORS

  1. Minors may be present on the premises of Wesoła Immersive only in accordance with the rules set out in the Exhibition Regulations (Section III), i.e.:

    • Persons under the age of 13 – only under the supervision of an adult.

    • Persons aged 13-17 – only with the written consent of a legal guardian.

  2. Wesoła Immersive does not conduct childcare or educational activities for children without the presence of their guardians.

II. RULES OF CONTACT BETWEEN STAFF AND MINORS

  1. Wesoła Immersive employees do not conduct individual conversations with minors without the presence of their guardians.

  2. Any physical contact with minors is prohibited, except in situations requiring intervention in emergencies.

  3. Staff do not engage in private communication with minors (e.g., via social media, SMS, etc.).

III. REPORTING INCIDENTS

  1. Any person (guest, employee, volunteer) who notices a situation threatening the well-being of a minor is obliged to report it immediately to the Wesoła Immersive Coordinator or directly to the appropriate services (Police, Social Welfare Center).

  2. In emergencies, call the emergency number 112.

IV. STAFF VERIFICATION

  1. All employees and associates who may have contact with minors are verified in the Registry of Sexual Offenders.

  2. Newly hired employees sign a declaration of no criminal record and confirm they have familiarized themselves with these standards.

V. EDUCATION AND INFORMATION

  1. Wesoła Immersive employees are familiar with the principles of minor protection and are obliged to adhere to them.

  2. The standards are available on the website and at the institution's premises.
